Privacy policy
Last updated:
This policy explains how LeadWise Marketing (Pty) Ltd (“LeadWise”, “we”, “us”) collects, uses and protects personal information when you visit leadwisemarketing.com, request an audit, or contact us by email, phone or WhatsApp. We are a company registered in South Africa (registration number 2026/669546/07), based in Cape Town, and we work with businesses in the United States and Europe.
The short version. We collect only what we need to answer your request and run our business. We never sell your information. Analytics and advertising cookies stay off unless you switch them on. You can ask us to see, correct or delete your information at any time by emailing ogs@leadwisemarketing.com.
Who is responsible for your information
LeadWise Marketing (Pty) Ltd is the controller of your personal information under the EU General Data Protection Regulation (GDPR) and the UK GDPR, and the responsible party under South Africa’s Protection of Personal Information Act (POPIA).
Contact: LeadWise Marketing (Pty) Ltd, Cape Town, South Africa · ogs@leadwisemarketing.com · WhatsApp +27 81 458 5909. Our Information Officer under POPIA can be reached at the same email address. We have not appointed a Data Protection Officer because our activities do not require one.
Representative in the EU and the UK
Because we offer our services to businesses in the European Union and the United Kingdom, the GDPR and the UK GDPR apply to the personal information we process about people there. At the date of this policy we have no establishment in the EU or the UK. Where the law requires us to appoint a representative there, their contact details will be published in this section. Until then, please contact us directly. You can also contact your local supervisory authority at any time (see your rights).
What we collect
Information you give us
When you complete our audit request form, we collect your name, email address and business name, the country you work in and your industry, plus anything else you choose to add: your role, phone number, website, primary service, advertising budget range, main challenge, current lead sources and a free-text description of what you want to improve. When you email, call or message us on WhatsApp, we receive the information you send.
Information collected when you use the website
When you submit the form, we record the page you submitted it from, the referring website and the time of submission. If you have accepted analytics or advertising cookies, we also record how you arrived (campaign parameters such as utm_source, and ad click identifiers such as gclid or fbclid) so we can see which marketing brought you to us. Our hosting provider keeps standard server logs (IP address, browser type, pages requested and time) to run and secure the website. With your consent only, analytics and advertising tools may collect information about your visit, as described in our cookie policy.
Business contact information from other sources
When we research businesses that may benefit from our services, we may collect business contact details (name, job title, company, business email or phone number and company location) from public sources such as company websites and professional networks. We use these details only to contact you about our services in a business capacity. You can object at any time, and we will stop.
Why we use it, and our legal basis
| What we do | Information used | Legal basis (GDPR and UK GDPR) | POPIA justification |
|---|---|---|---|
| Prepare the audit you asked for and reply to your enquiry, including a short confirmation email | Form details, messages you send us | Steps taken at your request before a contract (Art. 6(1)(b)); our legitimate interest in answering business enquiries (Art. 6(1)(f)) | Necessary to take steps towards a contract; legitimate interests |
| Run a working relationship if you become a client: plans, reports, invoices | Contact and business details, contract and billing records | Performance of a contract (Art. 6(1)(b)); legal obligation for tax and company records (Art. 6(1)(c)) | Contract; legal obligation |
| See which pages and campaigns bring in enquiries | Analytics data, campaign parameters and click identifiers | Your consent (Art. 6(1)(a)), given through the cookie banner | Consent |
| Measure and improve our own advertising on Google and Meta | Advertising cookies and conversion events | Your consent (Art. 6(1)(a)) | Consent |
| Contact businesses that may benefit from our services | Business contact details | Our legitimate interest in promoting our business to other businesses (Art. 6(1)(f)); you can object at any time | Legitimate interests, subject to your right to object |
| Keep the website and our systems secure and prevent spam or abuse | Server logs, form spam checks | Legitimate interests (Art. 6(1)(f)) | Legitimate interests |
Where we rely on legitimate interests, we have balanced them against your rights and expectations. You can ask us for more detail about that balance.
Do you have to give us your information?
No. To prepare an audit, we need your name, email address, business name, country and industry. Everything else on the form is optional. If you prefer not to use the form, you can email or message us instead. We do not make decisions about you based solely on automated processing, and we do not profile you in a way that has legal or similarly significant effects.
Who we share it with
We do not sell your personal information, and we do not share it for cross-context behavioral advertising unless you accept advertising cookies. We share it only with service providers that help us run our business, under contracts that require them to protect it and use it only on our instructions:
- Hostinger, which hosts this website and our business email.
- Google, which stores form submissions in Google Sheets through Google Apps Script and emails them to us; and, only if you consent, Google Analytics, Google Tag Manager and Google Ads.
- Meta, when you choose to message us on WhatsApp; and, only if you consent, the Meta Pixel.
- Professional advisers such as accountants and lawyers, and authorities where the law requires it.
If you message us on WhatsApp, Meta processes that conversation under its own terms and privacy policy.
International transfers
Please note that we are based in South Africa, which does not have an adequacy decision from the European Commission or the UK government. When you send us information from the EU or the UK, you are providing it directly to a company outside the European Economic Area and the UK, and we protect it to the standard the GDPR and the UK GDPR require.
Some of our providers process information in other countries, including the United States and member states of the EU. Where we transfer personal information from the EU or the UK to a provider in a country without an adequacy decision, we rely on the EU-US Data Privacy Framework (and its UK Extension) where the provider is certified, or on the European Commission’s standard contractual clauses (with the UK International Data Transfer Addendum) included in the provider’s data processing terms. Transfers out of South Africa meet the conditions in section 72 of POPIA. You can ask us for more information about these safeguards.
How long we keep it
- Enquiries and audit requests that do not lead to work: deleted automatically 24 months after they arrive, or sooner if you ask.
- Client records, such as contracts and invoices: kept for as long as South African tax and company law requires (currently five years in most cases), then deleted.
- Business contact details we collected for outreach: deleted if you object, or 12 months after our last contact with you if we have not worked together. We keep a minimal “do not contact” note so we respect your objection.
- Your cookie choice: 12 months, after which we ask again. Attribution details held in your browser: until you close it.
- Analytics data: we configure Google Analytics to keep event data for no longer than 14 months. Server logs are kept by our hosting provider for a limited period for security.
Your rights
Under the GDPR, the UK GDPR and POPIA, you have the right to:
- ask for a copy of the personal information we hold about you;
- ask us to correct it, or to delete it;
- ask us to restrict how we use it, and to receive the information you gave us in a portable format;
- object to our use of it where we rely on legitimate interests, and object to direct marketing at any time, in which case we will stop;
- withdraw your consent at any time, for example by using the “Cookie settings” button at the bottom of every page. Withdrawing consent does not affect processing that happened before.
To use any of these rights, email ogs@leadwisemarketing.com. We may need to confirm your identity first. We reply within one month, and we will tell you if a complex request needs longer (up to two further months). There is normally no charge.
You also have the right to complain to a supervisory authority. We would appreciate the chance to resolve your concern first, but you do not have to contact us before you complain:
- In the EU: the data protection authority in your country. The European Data Protection Board lists them all at edpb.europa.eu.
- In the UK: the Information Commissioner’s Office, ico.org.uk.
- In South Africa: the Information Regulator, inforegulator.org.za.
If you are in the United States
If you live in a US state with a consumer privacy law, you may have similar rights to know, access, correct and delete your personal information, and to opt out of its sale or its sharing for targeted advertising. We do not sell personal information. We honor requests to access, correct and delete from anywhere in the US, whether or not a state law applies to us, and we will not treat you differently for making one. If your browser sends a Global Privacy Control signal, we treat it as an opt-out of advertising cookies.
Security
We limit who can see enquiries, secure the accounts that hold them with strong passwords and two-step verification, and encrypt connections to this website (HTTPS). No system is completely secure, but if a breach affecting your information ever happens, we will notify you and the relevant authorities as the law requires.
Children
Our website and services are for businesses. They are not directed at anyone under 18, and we do not knowingly collect information about children.
Changes to this policy
We will update this policy when our practices or the law change. The “last updated” date at the top shows when it last changed. If a change affects how we use information you have already given us, we will tell you.
